By creating an account or using My Vista Scout (“Scout”, “the Service”) you agree to these terms. If you don’t agree, please don’t use the Service.
1. What Scout is
Scout is an independent informational tool that reads publicly available listings from vistaauction.com and overlays resale-price estimates, suggested bid ceilings, and risk indicators based on comparable sales across Facebook Marketplace, eBay, and Amazon. Scout does not place bids, take payments, or transact lots. All bidding still happens on Vista; we just help you decide.
Scout is not affiliated with, endorsed by, or sponsored by Vista Auction, Facebook Marketplace, eBay, or Amazon.
2. Eligibility
You must be at least 16 years old and able to enter a binding contract in your jurisdiction. By signing up you confirm you meet both bars.
3. Your account
- Provide accurate signup information and keep it current.
- Keep your password confidential. You’re responsible for everything done under your account.
- Tell us at [email protected] if you suspect unauthorized access.
- One account per person, please. Sharing one account between multiple resellers is not supported.
4. Acceptable use
You agree not to:
- Scrape, mirror, or resell Scout’s data or interface.
- Hammer the API beyond a reasonable rate (we publish rate limits on auth endpoints; the same spirit applies to the dashboard).
- Reverse-engineer, decompile, or attempt to extract the resale-comp model or source code.
- Use Scout to harass, defame, or facilitate illegal activity.
- Probe, scan, or test the vulnerability of the Service without our written permission.
We may suspend or close accounts that violate these rules, with notice when feasible.
5. The resale estimates
Resale ranges, confidence scores, suggested ceilings, and risk indicators are estimatesbuilt from public comparable sales. They’re a decision aid, not a guarantee. Markets move, condition descriptions lie, your local channel is unique. You are solely responsible for the bids you place and any profit or loss that follows.
6. Pricing
Scout is free for everyone during the beta. After we leave beta we’ll switch to a flat monthly subscription; we’ll email you at least 30 days in advance, and you’ll be able to keep using the free tier through the notice period or close your account at any point.
7. Intellectual property
Scout, the “My Vista Scout” name, the dashboard, our resale-comp methodology, and the codebase are ours. You retain ownership of the content you submit (saved searches, feedback) and grant us a worldwide, royalty-free licence to use it for the purpose of operating the Service.
8. Service availability
We’ll try hard to keep Scout up, but we can’t promise it. The Service depends on third parties (Vista’s listings, Cloudflare, Resend, our infrastructure provider) and on the public web. We may schedule maintenance windows or pause features at any time.
9. Disclaimers
The Service is provided “as is” and “as available”.To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that estimates will be accurate, complete, or current.
10. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of these Terms or your use of the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim and (b) USD $50. We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost bids, lost profits, lost data, or business interruption — even if advised of the possibility.
11. Indemnity
You’ll defend and indemnify us against claims arising from your misuse of the Service or violation of these Terms.
12. Termination
You can close your account anytime from the Delete account page. We may suspend or close accounts that breach these Terms, with notice when reasonable. Sections 5, 7, 9, 10, 11, and 13 survive termination.
13. Governing law & disputes
These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. Disputes go to the state or federal courts located in the United States, and you consent to that jurisdiction.
14. Changes
We’ll post updates here with a new “Last updated” date. Material changes that affect your rights will be announced by email at least 7 days before they take effect.
